These Terms and Conditions govern access to and use of the AVA International Photography Directory, available at clubs.artvisionawards.com.

By creating an account, submitting a listing or using the directory, you agree to these Terms and Conditions.

1. Purpose of the Directory

The AVA International Photography Directory provides an international platform where photographers, photography clubs, studios and creative organisations can:

• Create a public professional profile
• Present their work and activities
• Publish portfolio images
• Share professional contact information
• Discover other photographers and photography communities
• Develop professional and creative connections

The directory is separate from the Art Vision Awards photography competitions. Inclusion in the directory does not constitute selection, nomination, finalist status or recognition in an Art Vision Awards contest.

2. Acceptance of the Terms

By registering, submitting a listing or continuing to use the platform, users confirm that:

• They have read and accepted these Terms and Conditions
• The information they provide is accurate
• They have the legal capacity to create an account
• They have the necessary rights and permissions for all content submitted

Users who do not agree with these Terms must not create an account or submit a listing.

3. Account Registration

Users may be required to create an account to submit or manage a listing.

Users are responsible for:

• Providing accurate registration information
• Keeping their login credentials confidential
• Protecting access to their email account
• Informing us promptly of suspected unauthorised access
• Keeping their profile and contact information up to date

One person or organisation must not create misleading, fraudulent or impersonating accounts.

GZ PROD LTD may suspend an account where there are reasonable concerns relating to security, fraud, misuse or violation of these Terms.

4. Directory Listings

Listings may be available for:

• Individual photographers
• Photography studios
• Photography clubs
• Associations
• Creative communities
• Other relevant photography organisations approved by the directory

A listing may include:

• A name or professional title
• A biography or description
• A country, city or general location
• Photography specialties or activities
• Languages spoken
• Portfolio photographs
• Logos and profile images
• Website and social media links
• Professional contact information

Users are responsible for reviewing their listing and ensuring that all published information remains correct.

5. Submission Review and Approval

Listings may be subject to moderation before publication.

Submission of a listing does not guarantee publication.

GZ PROD LTD may:

• Approve a listing
• Request corrections or additional information
• Reject a listing
• Temporarily suspend a listing
• Remove content that violates these Terms
• Remove duplicate, abandoned or misleading listings

Moderation decisions may take account of content quality, relevance, accuracy, legality and the integrity of the directory.

6. User Content and Responsibility

Users remain fully responsible for all text, images, logos, links and information submitted through their account.

Users must ensure that their content:

• Is accurate and not misleading
• Is relevant to photography or the listed organisation
• Does not violate copyright, trademark or privacy rights
• Does not impersonate another person or organisation
• Does not contain unlawful, defamatory or discriminatory material
• Does not contain malware, spam or deceptive links
• Does not expose personal information without permission
• Complies with applicable laws

Users must obtain any necessary model releases, property permissions, licences or other authorisations before uploading photographs.

7. Prohibited Content

The following content is prohibited:

• Child sexual exploitation or abuse material
• Pornographic or explicitly sexual content
• Content promoting hatred, terrorism or unlawful discrimination
• Credible threats or incitement to violence
• Defamatory or knowingly false allegations
• Stolen or unauthorised photographs
• Content infringing intellectual-property rights
• Fraudulent contact details or misleading identities
• Spam, mass advertising or irrelevant commercial promotions
• Malware, phishing links or harmful software
• Content that violates applicable law

Artistic nudity may be reviewed individually and may be refused where it is inappropriate for a public professional directory.

8. Copyright and Ownership

Users retain ownership of their original photographs, logos, texts and other content.

GZ PROD LTD does not claim ownership of user-submitted work.

Users confirm that they either own the submitted content or have received sufficient authorisation from the relevant copyright holder.

Where a listing includes work created by another photographer or contributor, appropriate credits should be included where reasonably required.

9. Licence Granted to the Directory

By submitting content, users grant GZ PROD LTD a non-exclusive, worldwide, royalty-free licence to:

• Store the content
• Display it on the directory
• Generate thumbnails and resized versions
• Present it in search results
• Display it on public profile pages
• Promote the relevant listing or directory
• Share the profile through AVA’s editorial, newsletter and social media channels

This licence is limited to operating and promoting the directory and the user’s public profile.

The licence normally ends when the content or listing is removed, except where temporary backup copies, cached pages or previously published editorial materials remain reasonably necessary.

10. Profile Images and Portfolio Content

Users should upload only images suitable for a professional and publicly accessible directory.

The directory may resize, crop or compress images for technical display purposes.

GZ PROD LTD is not responsible for differences in image colour, resolution or presentation caused by:

• Screen settings
• Browser rendering
• Image compression
• Mobile display
• Third-party caching
• User-uploaded file quality

Users should retain their own original high-resolution files.

11. Public Availability and Search Engines

Approved listings are public.

Users acknowledge that their listing may:

• Be visible without logging in
• Appear in search-engine results
• Be shared by website visitors
• Be indexed by search engines
• Remain temporarily visible in external caches after removal

GZ PROD LTD cannot guarantee immediate removal from search-engine indexes or third-party caches.

12. Contact Between Users

The directory may allow visitors to contact photographers, clubs or organisations through published contact details or external links.

GZ PROD LTD is not a party to communications, agreements or transactions between users.

Users are responsible for assessing the identity, reliability and suitability of anyone they contact through the directory.

The directory does not guarantee:

• The identity of every listed person
• The accuracy of every professional claim
• The availability of a listed service
• The quality of any photography service
• The outcome of any commercial or creative collaboration

13. Free and Paid Services

Directory listings may currently be offered free of charge.

GZ PROD LTD may introduce optional paid services, enhanced visibility, promotional placements or premium features in the future.

Any price, renewal condition and cancellation rule will be clearly presented before purchase.

Nothing in these Terms removes statutory consumer rights. Terms that attempt to exclude or restrict mandatory consumer remedies may be unenforceable under UK law.

14. Payments and Refunds

Where a paid service is offered:

• The applicable price will be displayed before payment
• Payment may be processed by an authorised third-party provider
• Users must provide accurate billing information
• Refund rights will be determined by the service purchased, applicable law and the specific purchase conditions
• Statutory consumer rights remain unaffected

The platform should not state that all payments are automatically non-refundable in every circumstance, because consumer remedies may apply where a digital service is faulty, misdescribed or not supplied as agreed.

15. Suspension and Removal

GZ PROD LTD may suspend or remove an account or listing where reasonably necessary because of:

• Violation of these Terms
• Fraud or impersonation
• Copyright complaints
• Security concerns
• Spam or misuse
• Unlawful content
• Repeated failure to correct inaccurate information
• Abusive behaviour towards staff or other users
• Technical risk to the platform

Where appropriate, the user may be given an opportunity to correct the issue.

Immediate removal may occur where content creates a serious legal, security or safety risk.

16. Reporting Content

Users and visitors may report content that they believe:

• Infringes copyright
• Violates privacy rights
• Is false or misleading
• Contains unlawful material
• Impersonates another person
• Violates these Terms

The report should identify the relevant listing, explain the concern and include supporting information where available.

17. Intellectual-Property Complaints

A copyright or trademark complaint should include:

• The complainant’s name and contact details
• Identification of the protected work
• Identification of the allegedly infringing content

• An explanation of the complainant’s rights
• A good-faith statement that the use is unauthorised

GZ PROD LTD may temporarily remove disputed content while reviewing a complaint.

18. Availability of the Platform

GZ PROD LTD aims to maintain access to the directory but does not guarantee uninterrupted or error-free availability.

The platform may be temporarily unavailable because of:

• Maintenance
• Security updates
• Hosting failures
• Software updates
• Network problems
• Events outside reasonable control

Features may be modified, replaced or discontinued where reasonably necessary.

19. Third-Party Services and Links

The directory may contain links to:

• Personal websites
• Social media platforms
• Portfolio services
• Booking platforms
• External organisations

GZ PROD LTD does not control these third-party services and is not responsible for their:

• Content
• Security
• Availability
• Privacy practices
• Products or services
• Contractual arrangements

Users access external websites at their own discretion.

20. Disclaimer

The directory is provided as an information and professional-discovery platform.

GZ PROD LTD does not guarantee that:

• Every listing is complete or current
• Every user is professionally qualified
• Every image is authentic
• Every contact request will receive a response
• Use of the directory will generate work, clients, publicity or commercial opportunities

Users should carry out their own checks before entering into any professional, financial or creative arrangement.

21. Limitation of Liability

Nothing in these Terms excludes or limits liability where exclusion would be unlawful, including liability that cannot legally be excluded under applicable consumer law.

To the extent permitted by law, GZ PROD LTD will not be liable for indirect or consequential losses arising from:

• Reliance on information in a listing
• Communications between users
• Third-party websites
• Lost commercial opportunities
• Unauthorised use of content by third parties
• Temporary platform interruption
• Loss caused by a user’s failure to secure their account

Consumer contract terms must remain fair, transparent and must not remove mandatory statutory rights.

22. Indemnification

To the extent permitted by applicable law, users may be responsible for losses, claims or reasonable costs arising from:

• Content they submit
• Their infringement of third-party rights
• False or misleading information
• Their unlawful use of the platform
• Their material violation of these Terms

This clause does not limit any rights or protections that cannot legally be excluded.

23. Privacy and Data Protection

Personal information is processed in accordance with the directory’s separate Privacy Policy.

Privacy information should remain distinct from contractual terms and should clearly explain the purposes of processing, retention periods and recipients of personal information.

24. Account and Listing Closure

Users may request closure of their account or removal of a listing.

Before processing a request, GZ PROD LTD may request reasonable proof of account ownership or identity.

Certain limited records may be retained where required for legal compliance, security, dispute resolution or accounting.

25. Changes to These Terms

GZ PROD LTD may update these Terms to reflect:

• New functionality
• Changes in applicable law
• Security requirements
• New paid or promotional services

Material changes should be communicated where reasonably appropriate.

The latest revision date will appear at the top of the page.

Continued use after an update constitutes acceptance of the revised Terms where permitted by law.

26. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue to apply.

The invalid provision will be interpreted or adjusted only to the extent necessary to make it lawful and enforceable.

27. No Waiver

Failure by GZ PROD LTD to enforce a provision immediately does not constitute a permanent waiver of that provision or any other right.

28. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales.

The courts of England and Wales will have jurisdiction, subject to any mandatory rights allowing consumers to bring proceedings in another competent jurisdiction.
